Massachusetts Amends its SORNA Law

On August 6, 2010, Govt. Deval Patrick signed a new law that will (among other things) ban sex offenders from driving ice cream trucks and require all homeless sex offenders to wear GPS devices while homeless and verify their registration data in-person every 30 days.

The new law will take effect on November 4, 2010, and will potentially apply not only to registered sex offenders, but also homeless sex offenders who had previously been relieved of registering.

Many are claiming that the new law is unconstitutional as it applies to homeless sex offenders and plan to litigate the matter in court.  Unfortunately, Massachusetts is not the first to propose that all homeless sex offenders wear GPS monitoring until they find permanent residences.  See the 8/13/10 post in “Residency Restriction” concerning pending Ohio legislation.

Do you think it’s fair to require homeless sex offenders to re-register (in-person at the local police station) once a month and wear a GPS bracelet until they can find a home?  What about preventing convicted sex offenders from driving ice cream trucks?
